PARTICIPANT ACKNOWLEDGMENT OF RISK, RELEASE OF LIABILITY, WAIVER, AND AGREEMENT PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS. In consideration of being permitted to participate in kayaking, canoeing, paddling, camping, hiking, wildlife viewing, instruction, guided tours, transportation when applicable, meals, and any other activities, services, or experiences provided, organized, sponsored, or facilitated by Driftwood Paddling Tours LLC, hereafter referred to as “Driftwood,” I acknowledge and agree to the following: 1. VOLUNTARY PARTICIPATION AND ASSUMPTION OF RISK I understand that participation in paddling, camping, outdoor recreation, and wilderness activities involves inherent and other risks that cannot be completely eliminated, regardless of the care taken by Driftwood, its owners, guides, employees, contractors, volunteers, agents, representatives, or affiliated entities. I voluntarily choose to participate with full knowledge that these activities may result in property damage, illness, bodily injury, permanent disability, paralysis, emotional distress, or death. I knowingly and voluntarily assume all risks associated with my participation, whether such risks are known or unknown, anticipated or unanticipated, foreseeable or unforeseeable, inherent or otherwise, except to the extent such risks cannot lawfully be assumed or waived. 2. WATER AND PADDLING RISKS I understand that risks associated with kayaking, canoeing, and other water activities include, but are not limited to: Capsizing, falling from or being ejected from a kayak or canoe, drowning, near drowning, entrapment, immersion, strong or changing currents, waves, wakes from boats, changing water levels, shallow water, deep water, submerged objects, logs, branches, rocks, stumps, vegetation, mud, unstable shorelines, slippery surfaces, unexpected drops, underwater hazards, collisions with other vessels or objects, equipment failure, loss of paddle or equipment, difficulty entering or exiting a vessel, fatigue, overexertion, and inability to return to shore without assistance. I understand that wearing a personal flotation device reduces certain risks but does not eliminate the possibility of serious injury or death. 3. WEATHER AND ENVIRONMENTAL RISKS I understand that outdoor conditions can change rapidly and without warning. Risks include, but are not limited to, lightning, thunderstorms, heavy rain, wind, fog, extreme heat, cold temperatures, sudden temperature changes, high humidity, sun exposure, ultraviolet exposure, dehydration, heat exhaustion, heat stroke, hypothermia, sunburn, reduced visibility, falling trees or limbs, wildfire, unstable terrain, flooding, and other natural environmental conditions. I understand that Driftwood may alter, delay, shorten, relocate, or terminate an activity when conditions warrant, but conditions may change unexpectedly despite reasonable planning and monitoring. 4. WILDLIFE, PLANT, AND INSECT RISKS I understand that activities may occur in natural habitats containing wild animals, insects, plants, microorganisms, and other biological hazards. These may include, but are not limited to, alligators, snakes, venomous snakes, turtles, mammals, birds, fish, spiders, ticks, mosquitoes, biting flies, bees, wasps, ants, other insects, parasites, bacteria, fungi, poisonous or irritating plants, thorns, vegetation, algae, and wildlife diseases. Wild animals are unpredictable and may bite, scratch, sting, charge, strike, pursue, or otherwise injure a participant. I understand that no representation or guarantee can be made that wildlife will remain at any particular distance from me or that encounters can always be prevented. I agree not to approach, touch, feed, harass, pursue, or interfere with wildlife and agree to follow all guide instructions concerning wildlife encounters. 5. REMOTE AND WILDERNESS CONDITIONS I understand that some Driftwood activities occur in remote areas, including portions of the Okefenokee National Wildlife Refuge, where immediate medical care, emergency personnel, hospitals, roads, cellular service, and conventional emergency transportation may not be readily available. Emergency response or evacuation may require significant time and may involve paddling, walking, boating, emergency vessels, motor vehicles, aircraft, or other methods. Communication equipment, including cellular phones, radios, satellite communication devices, or other emergency devices, may fail, lose signal, become damaged, or otherwise be unavailable. I accept the additional risks created by participating in remote areas and understand that delays in receiving emergency medical care could worsen an injury or medical condition. 6. CAMPING AND OVERNIGHT RISKS For activities that include camping or overnight accommodations, I understand that additional risks may include uneven ground, darkness, limited lighting, slips and falls, tent or equipment failure, falling trees or branches, cooking equipment, campfires, burns, smoke, food preparation, insects, wildlife encounters, weather exposure, sleep disruption, shared facilities, remote toilet facilities, and limited access to running water, electricity, shelter, or medical assistance. 7. FOOD AND ALLERGY RISKS When meals, snacks, beverages, or food preparation are provided, I understand that Driftwood cannot guarantee that food will be completely free of allergens or cross contact. I am responsible for informing Driftwood of known food allergies, dietary restrictions, or medical dietary requirements before participation. I understand that wilderness and outdoor food preparation environments may differ from commercial kitchens and voluntarily accept the associated risks. 8. PHYSICAL AND MEDICAL CONDITIONS I represent that I am physically and mentally capable of participating in the activity I have selected, or that I have disclosed to Driftwood any limitation that may reasonably affect my ability to participate safely. I understand that paddling and outdoor activities may involve repetitive movement, physical exertion, twisting, lifting, balancing, sitting for extended periods, entering and exiting watercraft, walking on uneven terrain, exposure to heat or cold, and other physical demands. Possible medical events include, but are not limited to, allergic reactions, asthma attacks, breathing difficulty, fainting, seizures, cardiac events, diabetic emergencies, dehydration, heat illness, hypothermia, musculoskeletal injury, aggravation of preexisting conditions, anxiety, panic reactions, and other unexpected illnesses or medical emergencies. I understand that Driftwood personnel cannot diagnose medical conditions or guarantee that an activity is appropriate for my individual health circumstances. 9. EQUIPMENT I understand that Driftwood may provide kayaks, canoes, paddles, personal flotation devices, camping equipment, safety equipment, and other gear. Although reasonable efforts may be made to inspect and maintain equipment, equipment may break, malfunction, become damaged, move unexpectedly, or fail. I agree to use equipment only as instructed, notify a guide of any known or suspected problem, and refrain from intentionally misusing or damaging equipment. 10. PARTICIPANT CONDUCT AND THIRD PARTIES I understand that injuries may result from my own actions or inactions, the actions or inactions of other participants, members of the public, boat operators, motorists, property owners, government agencies, independent contractors, wildlife, or other third parties. I agree to follow safety instructions, remain within designated areas when instructed, wear required safety equipment, maintain appropriate distance from wildlife and other hazards, and conduct myself in a manner that does not create an unreasonable risk to myself or others. I understand that failure to follow guide instructions may result in my removal from an activity. 11. RELEASE AND WAIVER OF LIABILITY FOR ORDINARY NEGLIGENCE To the fullest extent permitted by applicable law, I voluntarily release, waive, discharge, and agree not to sue Driftwood Paddling Tours LLC, its owners, members, managers, guides, employees, contractors, volunteers, agents, representatives, successors, assigns, affiliated organizations, and property owners or entities whose property or facilities are used in connection with the activity, collectively referred to as the “Released Parties,” for claims arising from or relating to my participation in Driftwood activities, including claims arising from the ordinary negligence of a Released Party. This release includes claims for bodily injury, illness, disability, death, emotional injury, property loss, property damage, medical expenses, evacuation expenses, and other losses arising from my participation, to the fullest extent such claims may legally be released. Nothing in this agreement is intended to release liability that cannot lawfully be released under applicable law. 12. RELEASE OF UNKNOWN CLAIMS I understand that injuries, illnesses, or damages may not be immediately apparent. I intend this agreement to apply to claims involving injuries, conditions, losses, or consequences that are known or unknown at the time I sign this agreement, to the fullest extent permitted by law. 13. MEDICAL TREATMENT AND EMERGENCY AUTHORIZATION If I become injured or ill and am unable to make decisions for myself, I authorize Driftwood personnel to obtain or request emergency medical assistance when they reasonably believe such assistance is necessary. This may include contacting emergency services, administering basic first aid within the responder's training, arranging emergency transportation or evacuation, and sharing information reasonably necessary for emergency treatment. I understand that Driftwood does not guarantee the availability, timing, or outcome of medical treatment. I accept financial responsibility for medical treatment, rescue, evacuation, transportation, medications, hospital care, or other expenses incurred on my behalf, except where otherwise required by law. 14. PERSONAL PROPERTY I understand that Driftwood is not responsible for loss, theft, water damage, breakage, or destruction of phones, cameras, clothing, vehicles, keys, glasses, jewelry, medications, personal gear, or other personal property, except to the extent liability cannot lawfully be waived. 15. INDEMNIFICATION To the fullest extent permitted by law, I agree to indemnify and hold the Released Parties harmless from claims, liabilities, damages, or expenses arising from my own negligent, reckless, intentional, or unlawful conduct during the activity, including damage or injury I cause to another person or property. 16. COMPLIANCE WITH RULES AND GUIDE AUTHORITY I agree to comply with all instructions provided by Driftwood guides and all applicable park, refuge, governmental, safety, environmental, boating, and wildlife regulations. I understand that Driftwood reserves the right to refuse participation, remove a participant from an activity, modify an itinerary, or terminate participation when Driftwood reasonably determines that a person's conduct, condition, weather, wildlife activity, water conditions, equipment conditions, or other circumstances create a safety concern. 17. NO GUARANTEE OF CONDITIONS OR EXPERIENCE I understand that Driftwood cannot guarantee weather, wildlife sightings, water levels, route availability, campsite availability, trail conditions, paddling conditions, trip duration, or access to any particular destination. Outdoor experiences are inherently affected by natural conditions and may be modified when circumstances require. 18. MINORS If the participant is under eighteen years of age, I represent that I am the participant's parent or legal guardian and that I have authority to sign this agreement. I consent to the minor's participation and acknowledge the risks described in this agreement. To the fullest extent permitted by law, I release any claims that I personally may have arising from the minor's participation, including claims for medical expenses, loss of services, or other derivative claims. I authorize emergency medical care for the minor as described above. 19. GOVERNING LAW AND SEVERABILITY This agreement shall be interpreted under the laws of the State of Georgia to the extent applicable. If any provision of this agreement is determined to be invalid or unenforceable, that provision shall be limited or severed to the extent necessary, and the remaining provisions shall continue in full force and effect to the fullest extent permitted by law. 20. ACKNOWLEDGMENT AND ELECTRONIC SIGNATURE I certify that I have had the opportunity to read this entire agreement before signing it. I understand its terms and understand that by signing it I am giving up substantial legal rights, including certain rights to bring claims against Driftwood Paddling Tours LLC and the Released Parties. I certify that the information I have provided is accurate. I sign this agreement freely and voluntarily and understand that my electronic signature is intended to have the same effect as my handwritten signature.
